PROOF OF CLAIM:
The bankruptcy court has abated the claims bar date. This means that no deadline is currently in place by which to file a proof of claim. IF the bankruptcy trustee determines that there will be assets recovered through this bankruptcy case, notice will be mailed and/or published letting creditors know that they should file their claims. Until such notice is mailed and/or published, creditors do not need to file proofs of claim. A proof of claim is the document an individual or entity uses to assert a claim against the bankruptcy estate of a debtor. Instead, a meeting of creditors is conducted by a trustee who will ask questions of a debtor or a debtor’s representative. The debtor or the debtor’s representative is under oath when answering these questions. Creditors are NOT required to attend this meeting, and a failure to attend this meeting will NOT hurt a creditor’s rights.
